1. Relationship with Australian Consumer Law

This Warranty and Workmanship Policy provides additional assurances and does not replace or limit rights under the Australian Consumer Law.

Consumer rights may continue beyond the express warranty periods below, depending on the nature, price, expected durability and use of the Goods or Services.

2. Express warranty periods

Unless a quotation, product description or manufacturer warranty provides a longer period, Hexforge Industries offers the following voluntary express warranties:

2.1 Goods manufactured by Hexforge Industries

A 12-month warranty from delivery or collection against defects in materials or manufacture attributable to Hexforge Industries.

2.2 Hexforge workmanship

A 12-month warranty from completion against defects caused by our workmanship in:

  • fabrication;
  • assembly;
  • installation;
  • painting;
  • finishing;
  • custom furniture work;
  • modifications; and
  • other Services.

2.3 Repairs and alterations

A 90-day warranty from completion for the specific repaired or altered component and the work we performed.

This does not warrant unrelated components or the remaining life of an aged or customer-supplied product.

2.4 Third-party Goods

Third-party Goods may carry a separate manufacturer warranty.

We will not require a consumer to deal only with the manufacturer where Hexforge Industries, as the supplier, has an obligation to provide a remedy under the ACL.

3. What this express warranty covers

Subject to assessment, the warranty covers:

  • manufacturing defects;
  • material defects attributable to materials selected and supplied by us;
  • failure to follow an approved Specification;
  • defective assembly;
  • defective installation performed by us;
  • abnormal coating or paint failure caused by poor preparation or application;
  • bonded components separating because of defective workmanship; and
  • dimensional errors outside the agreed tolerance caused by us.

4. Remedies under the express warranty

Where a valid express warranty claim is accepted, we may provide one or more of:

  • inspection;
  • adjustment;
  • repair;
  • re-performance of Services;
  • replacement;
  • remake;
  • reimbursement of reasonable approved expenses; or
  • another appropriate remedy.

The remedy offered under this voluntary warranty does not restrict any remedy you may be entitled to choose under the ACL.

5. Exclusions from the voluntary express warranty

The voluntary express warranty does not cover damage caused by:

  • misuse;
  • abuse;
  • accidents;
  • impact;
  • crushing;
  • excessive loads;
  • improper storage;
  • exposure to temperatures outside disclosed limits;
  • prolonged ultraviolet exposure where the material is not UV-rated;
  • moisture or chemicals incompatible with the material;
  • failure to follow care instructions;
  • unauthorised modification or repair;
  • installation by another person;
  • ordinary wear and tear;
  • paint wear caused by ordinary handling;
  • consumable parts;
  • use outside the disclosed intended purpose;
  • customer-supplied defects;
  • hidden pre-existing damage;
  • incorrect customer-supplied measurements;
  • force majeure events;
  • pests;
  • fire;
  • flood;
  • deliberate damage; or
  • cosmetic variations disclosed before purchase.

An exclusion applies only to the extent the excluded event caused or contributed to the failure.

These exclusions do not remove rights that cannot legally be excluded.

6. Three-dimensional printed Goods

The warranty does not treat the following as defects where they are reasonably consistent with the approved Specification:

  • ordinary layer lines;
  • minor support marks;
  • normal seam placement;
  • disclosed surface texture;
  • slight colour variation;
  • minor dimensional variation within the agreed tolerance; and
  • characteristics visible in an approved sample or proof.

The warranty may be declined where failure results from using a product:

  • above its stated temperature range;
  • beyond its stated load;
  • outdoors when not specified for outdoor use;
  • for food contact when not certified;
  • in a vehicle, electrical system or structural application without written approval; or
  • in another safety-critical application not included in the Specification.

7. Painted miniatures and models

The workmanship warranty may cover abnormal:

  • peeling;
  • flaking;
  • uncured coatings;
  • adhesive failure; or
  • failure to follow the approved scheme.

It does not ordinarily cover:

  • normal tabletop wear;
  • chipping caused by impact;
  • damage from unsuitable foam or storage;
  • damage from heat or moisture;
  • handling by unpainted metal edges;
  • damage to fragile manufacturer components; or
  • colour differences caused solely by screen display settings.

8. Furniture and timber products

Timber and similar natural materials may display:

  • grain variation;
  • knots;
  • minor colour differences;
  • seasonal movement; and
  • small changes caused by humidity.

These are not defects where reasonable for the material and consistent with the description.

The warranty may not cover movement or damage caused by:

  • extreme humidity;
  • standing water;
  • direct heat;
  • unsuitable cleaning products;
  • use on an uneven surface;
  • overloading;
  • failure to secure an item where anchoring was required; or
  • unauthorised structural modification.

9. Customer-supplied products

Where we work on customer-supplied property, the warranty applies to our workmanship and any materials we supply.

It does not guarantee:

  • the condition of the original item;
  • hidden defects;
  • manufacturer components;
  • previous repairs;
  • aged electronics;
  • brittle plastics;
  • degraded resin;
  • old adhesives;
  • incompatible coatings; or
  • unrelated parts.

We remain responsible for damage caused by our failure to exercise due care and skill.

10. Maintenance and care

You must take reasonable steps to:

  • follow provided instructions;
  • use the product for its intended purpose;
  • avoid excessive loads or temperatures;
  • keep the item appropriately clean and dry;
  • conduct stated maintenance;
  • store fragile products safely; and
  • stop using a product where continued use may cause further damage or injury.

Failure to maintain a product only affects a claim to the extent it caused or worsened the problem.

11. Making a warranty claim

To make a claim, contact us using the details below and provide:

  • your name;
  • Order or invoice number;
  • proof of purchase;
  • a description of the problem;
  • when the problem first appeared;
  • photographs or video;
  • information about use and storage; and
  • any other information reasonably required to assess the claim.

Do not undertake repairs or dispose of the item before we have had a reasonable opportunity to assess it, unless urgent action is necessary to prevent injury or further damage.

12. Assessment

We may assess a claim through:

  • photographs or video;
  • remote troubleshooting;
  • return of the item;
  • onsite inspection;
  • testing;
  • consultation with a manufacturer; or
  • an independent specialist where reasonably necessary.

We will assess claims fairly and within a reasonable time.

13. Transport and inspection costs

Where the claim is confirmed as covered, we will bear or reimburse reasonable costs associated with the approved remedy where required.

For large, heavy, installed or difficult-to-return Goods, contact us before arranging transport.

Where an inspection confirms that no covered defect exists, we may charge reasonable inspection or collection costs only where:

  • those costs are permitted by law;
  • we provided a reasonable estimate beforehand; and
  • the Customer agreed to proceed.

14. Replacement parts and repaired Goods

A repaired or replacement item remains covered for:

  • the remainder of the original express warranty period; or
  • 90 days after repair or replacement,

whichever is longer.

This additional period does not reduce rights under the ACL.

15. Data and digital files

Before equipment, storage devices or electronic products are returned for assessment, the Customer should back up important data where practicable.

We are not responsible for data loss that was unavoidable during an authorised repair process, except where caused by our failure to exercise due care and skill or where liability cannot legally be excluded.

16. Mandatory Australian Consumer Law notice

Before this Warranty Policy is issued with Goods or Services, Hexforge Industries must insert the current mandatory Australian Consumer Law warranty wording prescribed for:

  • Goods;
  • Services; or
  • combined Goods and Services,

as applicable to the relevant supply.

The prescribed wording must be reproduced exactly, together with the warrantor’s name, business address, telephone number, email address, claim procedure, warranty period, available remedies and responsibility for claim expenses.

The required notice must accompany the actual product or warranty document where legally required. Publication only on the Website may not be sufficient.
